RIP CIV! BIS to Remove License Exception CIV from the EAR

Rumors have circulated through the export community for months, and the Bureau of Industry and Security (BIS) has finally acted. In a final rule published April 28, 2020, BIS is removing License Exception Civil End-Users (CIV) (15 CFR §740.5) from the Export Administration Regulations (EAR).

CIV authorizes exports, reexports, and transfers (in-country) of certain items controlled for national security reasons without prior review by the Bureau of Industry and Security (BIS), provided the exception’s criteria are met. CIV applies to most civil end-users for civil end-uses in Country Group D:1,[1] which is a shortlist of countries, including the key export markets of China and Russia. The new final rule removing CIV from the Export Administration Regulations (EAR) is effective 60 days after publication, or June 29, 2020, making it a pleasant change from recent regulations that have become effective when they were made available for public inspection at the Federal Register.

Citing the increasing integration of civilian and military technology development in these D:1 countries, BIS determined the amalgamation makes it more difficult for industry to know whether the end use is not intended for military applications or users. As a result, BIS will simply delete CIV as a license exception from all ECCNs that had it, as well as from the EAR; §740.5 will be reserved. Exporters of impacted ECCNs to D:1 countries need to apply for and get an export license from BIS allowing review of the transaction in light of the objectives of the Administration’s National Security Strategy from December 2017 and the National Defense Strategy from January 2018, both of which are cited as precipitating this change.

For quick reference, CIV will no longer be available for exports of the following ECCNs from June 29, 2020:
