“With President Biden’s impending reelection prospects uncertain, the FTC will almost certainly double-down on its privacy initiatives. We can expect to see a notice of proposed rulemaking in connection with the Commercial Surveillance and Lax Security Practices docket and a revised Children’s Online Privacy Protection Rule,” Reed said.

“The FTC will also likely expand on its use of Notices of Penalty Offense on privacy issues so that it can obtain equitable monetary relief in Section 5 cases, continue to bring cases alleging the user interfaces and choice architecture employ illegal ‘dark patterns,’ and follow-up on its health data privacy enforcement activity with a focus on other types of sensitive personal information, including biometrics, financial information, kids’ data, and precise location information,” he added.
