    Questions On NFL's CTE Stance Unlikely To Upend Settlement

    Partner Gary Wolensky recently spoke with Law360 about the recent spotlight on the NFL’s position on the possibility of a connection between football head injuries and CTE. CTE, or chronic traumatic encephalopathy, is a degenerative brain condition that may be the result of football injuries, though it is hotly debated as more research on these types of injuries is still to come. A New York Times investigative report and one of its executives’ comments now have the NFL on the defensive against lawsuits and other attacks.

    “This is just an evolving area, evolving science. You have to start some place, and the NFL did that and did the best that it could,” said Mr. Wolensky. “The research keeps evolving and getting better and better and better. While some plaintiffs’ attorneys might try to use it and will try to use it, I don’t think it is going to be very effective.”
