California Expands Scope of Online Data Privacy

On January 1, Senate Bill 46 and Assembly Bill 370 took effect, expanding the scope of online data protection and notice requirements in California.
 
S.B. 46 enlarges the definition of “personal information” and requires California agencies and businesses to promptly disclose data security breaches involving a California resident’s login credentials that permit access to an online or email account. Under prior law, only “personal information” consisting of an individual’s first and last name, in conjunction with the individual’s Social Security number or driver’s license number was protected.
