    Arent Fox Attorneys File Amicus Brief on Behalf of LGBT Law Enforcement Officers

    Arent Fox filed an amicus brief with the US Court of Appeals for the Sixth Circuit on behalf of LGBT law enforcement officers and organizations. The brief was filed in three separate cases challenging same-sex marriage bans in Kentucky, Michigan, and Tennessee. Drawing on the unique perspective of law enforcement, the brief argues that laws that discriminate on the basis of sexual orientation should be subject to heightened scrutiny because of the long history of discrimination and harassment against gays and lesbians. It also demonstrates that bans on same-sex marriage uniquely harm LGBT law enforcement officers because when an officer is killed in the line of duty, only lawful “spouses” are automatically eligible for benefits.
